NextEra Energy, Inc. submitted the following document to the Federal Energy Regulatory Commission: Pursuant to Rule 213 of the regulations of the Federal Energy Regulatory Commission (“Commission”), NextEra Energy, Inc. (“NextEra”) and Dominion Energy, Inc. (“Dominion” and, together with NextEra, the “Applicants”), respectfully provide this answer (“Answer”) to the Motion for Expedited Clarification of the Comment Deadline in Light of the Deficiency Letter, or in the Alternative, for Extension of Time Until 30 Days after Applicants’ Supplemental Filing (the “Motion”) filed on September 24, 2026 by the Connecticut Attorney General, the Massachusetts Attorney General, and the Connecticut Department of Energy and Environmental Protection (the “Movants”). The Movants request that the Commission suspend the September 29, 2026 comment deadline and re-notice the Application after Applicants file their response to the Commission’s September 23, 2026 deficiency letter, or alternatively, that the Commission suspend the comment deadline until thirty days after the Application is complete. The Movants do not provide good cause for a second extension of the comment deadline, and the Commission should deny the Motion. As the Movants note, the Commission has already extended the comment deadline in this proceeding from the standard sixty days to seventy-five days. Movants and other intervenors already have had an extended period to review the Application. With the deadline five days away, those parties intending to file comments presumably have them in near final form. Parties should file their comments as scheduled so that the Commission and Applicants can begin considering them. Comments following and in response to Applicants’ response to the deficiency letter would thus be limited to the narrower set of issues raised in the deficiency letter, giving the Commission and Applicants a smaller set of issues to review and consider later in the proceeding. This would be in keeping with the Commission’s standard practice of setting responses to deficiency letters for public comment periods, not to adjust the comment period on the underlying application. The Movants will have time to review and comment upon the Applicants’ response to the deficiency letter, just as the Movants have had time to review and comment upon the Application. The Movants have not shown good cause to grant the extraordinary relief of a second extension to the comment deadline for the Application. For the reasons discussed herein, Applicants respectfully request that the Commission deny the Motion, keep the September 29, 2026 commend deadline for the Application, and separately notice the Applicants’ response to the deficiency letter when it is filed.
