Milberg PLLC is actively litigating social media addiction claims on behalf of Peoria Public Schools District 150, of Peoria, Illinois, as part of the Social Media Adolescent Addiction/Personal Injury Products Liability Litigation (MDL No. 3047)—the same federal case in which all four major social media platforms last month agreed to pay a landmark $27 million to resolve claims brought by a Kentucky school district, the first such case to reach the eve of trial. Meta Platforms ($9 million), Snap Inc. ($8 million), TikTok ($8 million), and YouTube ($2 million) collectively settled with Breathitt County School District in rural Kentucky to cover mental health costs and fund a 15-year abatement program. The settlement, reached just weeks before a June trial date, served as the first major test of school districts' claims against social media platforms. The Breathitt County settlement is part of a broader wave of accountability facing these platforms. In August 2026, Meta agreed to pay approximately $17 billion to settle a separate lawsuit brought by 29 state attorneys general in federal court in Oakland, resolving claims that the company violated child privacy laws and designed its platforms to be addictive to minors. That same month, the U.S. Department of Justice secured a $400 million settlement from TikTok and parent company ByteDance over violations of the Children's Online Privacy Protection Act (COPPA)—one of the largest recoveries ever obtained under that law—reflecting an escalating reckoning for these platforms on the issue of harm to minors. The MDL now includes more than 2,500 pending cases in federal court and an additional 3,300 in California state court. The cases allege that Meta, Snap, TikTok, and YouTube knowingly engineered their platforms to maximize engagement among minors, despite knowing that certain design features caused anxiety, depression, self-harm, and disrupted learning, and left school districts to bear the financial and human consequences. The next federal bellwether trial for school district claims is scheduled for February 2027. School districts in the litigation seek recovery for documented institutional costs, including mental health counseling, monitoring software, and the broader administrative burden of addressing a youth mental health crisis that school communities say these platforms deliberately created. Milberg represents Peoria Public Schools District 150 and additional school districts in this litigation. Districts that have not yet filed may still have time to join the MDL.

A Settlement has been proposed in class action litigation against Amazon.com. This class action alleges that certain of Amazon's return policies and practices violate Washington consumer protection and other laws. Amazon denies Plaintiffs' allegations and denies any wrongdoing. Amazon has, however, agreed to settle the lawsuit so that it may, among other things, avoid additional litigation burdens and expenses. The Court has not made any finding that Amazon has engaged in any wrongdoing or misconduct of any kind, or is liable in any way. The Court also has not made any determination that this lawsuit should proceed as a class action, as opposed to individual claims brought by Plaintiffs. If approved, the Settlement will resolve the litigation entitled In re: Amazon Return Policy Litigation, No. 2:23-cv-01372-JNW, pending in the United States District Court for the Western District of Washington. Settlement Class Members initiated a return to Amazon or requested a refund regarding a physical product purchased and per Amazon's records received in the U.S. after being sold through Amazon.com from September 5, 2017 to February 12, 2026, and incorrectly did not receive a refund from Amazon or received an untimely or incorrect refund from Amazon; and/or did receive a refund but were later incorrectly charged by Amazon for the product(s) that was (were) the subject of the return. After this litigation was filed, Defendant identified certain customer refunds that were potentially unpaid and, in 2025, elected to implement a process to pay those refunds, including by paying some refunds for which Amazon could not confirm the money was owed. These refunds include (1) refunds not completed due to a payment processing issue; and (2) refunds not completed where Amazon does not have sufficient confirmation that the correct item(s) were returned as required. As part of the consideration provided under this Settlement, Defendant has agreed to make reasonable efforts to complete payment of these refunds to Settlement Class Members outside of the Settlement Fund, and will pay an additional $309.5 million into a non-reversionary Common Fund, which will be used for distribution to the Settlement Class in accordance with the plan of distribution as well as all payments to the Settlement Administrator, and all remaining costs and expenses associated with the Settlement, including any attorneys' fees and incentive awards subject to Court approval. Amazon has invested $21.7 billion to support DSPs and their Delivery Associates and their drivers throughout the eight-year program history. Amazon is investing another $1.9 billion in the Delivery Service Partner (DSP) program in 2027, helping DSPs increase Delivery Associate (DA) pay to a national average of nearly $24/hour. Amazon is also committing $70 million over the next five years towards community impact initiatives led by DSP owners. Since 2022, Amazon has invested more than $543 million in safety initiatives, programs, and technology for DSP owners and their teams. By the end of this year, surround-view cameras will be installed in 50% of Rivian electric delivery vehicles across the network. Amazon is launching additional dynamic hazard alerts in the Amazon Delivery App, so DAs get real-time notifications about accidents, road closures, and construction ahead on their route. Navigation will now automatically adjust routes during inclement weather or when hazards are detected, without the DA having to take any action. Amazon is using more advanced AI techniques to identify driving trends that are more likely to lead to accidents and surfacing these insights to DSPs so that owners can provide early coaching for their teams. Over the past three years these investments will have helped DSP owners increase driver pay by an average of 16% nationwide, with national average earnings rising by roughly another $1 to nearly $24 per hour. The increased rates Amazon pays DSPs will continue to support them in recruiting and retaining high-performing teams. All DSPs provide healthcare coverage and paid time off for their full-time DAs, and many also offer 401(k) plans, tuition reimbursement and other benefits. Tech giant Google has been fined €403 million by the Data Protection Commission (DPC) over the processing of location data. Under data protection rules, such information must be processed in a lawful, fair and transparent manner. The DPC said that its investigation into Google found failures in this regard meaning that people could have been unaware that their location was being used to, for example, influence them with ads or to infer their interests, and could lose control over their personal data. The investigation focussed on the period of May 2018 to February 2020. It looked at location settings on services such as Google's search engine and Google Maps, as well as location accuracy features on Android devices. The DPC said that location data can bring both benefits and harms to individuals. The investigation was launched by the DPC in February 2020, following receipt of complaints from several European consumer rights organizations regarding Google’s processing of location data in connection with certain services and products. The decision, which was made by the Commissioners for Data Protection, Dr Des Hogan, Dale Sunderland and Niamh Sweeney, found that Google had infringed the General Data Protection Regulation (GDPR). The DPC has imposed fines totalling €403 million and has ordered Google to bring its processing into compliance within six months. In a statement, Google said the case centres around historical policies that have since been updated. The changes that have been introduced by Google include settings to automatically delete data, ad management tools, and increased transparency around how data is used. It is understood that Google will appeal the ruling focused on legal issues that require clarification beyond this case.

That same month, the U.S. Department of Justice secured a $400 million settlement from TikTok and parent company ByteDance over violations of the Children's Online Privacy Protection Act (COPPA)—one of the largest recoveries ever obtained under that law—reflecting an escalating reckoning for these platforms on the issue of harm to minors. Microsoft Corporation had submitted the following document to the Federal Energy Regulatory Commission. Pursuant to Rules 212 and 213 of the Federal Energy Regulatory Commission’s Rules of Practice and Procedure, Microsoft Corporation submits this answer to the September 8, 2026 responsive pleadings of American Transmission Company LLC and Wisconsin Electric Power Company, dba WeEnergies. Although the record in this case presents disputed issues of material fact that warrant further consideration, it also highlights areas of alignment among the parties: facilitating infrastructure development necessary for the timely interconnection and electric service to large retail loads, and ensuring that large retail customers bear an appropriate share of the associated grid costs, without shifting those costs to other wholesale or retail customers. Microsoft requested the Commission set this case for hearing and settlement judge procedures because those procedures provide a path to resolution while advancing shared goals. While an answer to an answer or protest is not a matter of right under the Commission’s regulations, the Commission routinely permits such answers when the answer provides useful and relevant information that will assist the Commission in its decision-making process, corrects factual inaccuracies and clarifies the issues, provides information helpful to the disposition of an issue, or permits the issues to be narrowed. This Answer satisfies each of these criteria, and accordingly Microsoft respectfully requests that the Commission grant leave and accept this Answer. ATC and WEPCo attempt to persuade the Commission that there are no disputed issues of material fact through lengthy answers disputing issues of material fact. Where there are disputed issues of material fact that cannot be resolved on the record, the Commission will set a case for hearing and settlement judge procedures. ATC and WEPCo disagree that any such dispute exists in this proceeding, and then devote nearly 40 pages to disputing Microsoft and other interveners’ arguments over issues of material fact. For ease of Commission staff reference, the table below illustrates just some instances of disputed material facts, based on the record to date. ATC and WEPCo’s responsive pleadings highlight the significant disagreement on these core cost-of-service rate issues, and for this reason Microsoft requests that the Commission set the Agreements for hearing and settlement judge procedures, as requested in Microsoft’s August 21 Protest. Microsoft has moved for hearing and settlement judge procedures specifically because this procedural path is the most effective means of achieving resolution. ATC’s and WEPCo’s claim that only the two signatories to their bilaterally negotiated agreements (themselves) are the appropriate parties to request hearing and settlement judge procedures has no support in Commission precedent or the Federal Power Act. In attempting to foreclose the possibility of further evidentiary procedures, WEPCo argues that granting Microsoft’s request would improperly give Microsoft a direct role in negotiating bilateral transmission contracts to which it is not a party and that the Agreements are between ATC and Wisconsin Electric, and Microsoft’s participation in this proceeding and status as an end-use customer does not make it a contracting party. ATC similarly argues that as a non-party to the bilateral agreements at issue between ATC and WEPCo, Microsoft’s request for a hearing and settlement process is an improper attempt to insert itself into the agreements to renegotiate the terms. Were the Commission to adopt ATC’s and WEPCo’s position that only the two signatories to their bilaterally negotiated agreements (themselves) are qualified to request hearing and settlement judge procedures, the policy consequences would be striking. Not only would this view preclude entities critical to the protection of retail end-users, including the Public Service Commission of Wisconsin itself, from ever seeking a procedural remedy before this Commission, but it would also disincentivize public utilities (whether affiliates like ATC and WEPCo, or otherwise) from ever including large retail end-users in their discussion of the applicable rates, terms, and conditions at all. This would be an especially bizarre outcome in this proceeding, where, together the LLCPAs and MTCA are designed to ensure proper cost allocation to large load customers. Moreover, ATC and WEPCo appear to conflate the concept of a bilateral contract with a FERC-filed rate schedule under section 205 of the Federal Power Act. Microsoft did not protest the July 24 Filing because ATC negotiated bilateral contracts with WEPCo. It protested the July 24 Filing because ATC is seeking to make the rates, terms, and conditions of those bilateral contracts binding under FPA section 205. There is simply nothing in the Commission’s regulations that prevents Microsoft, the Wisconsin Commission, and any other timely intervener from disputing issues of material fact within the provisions of rate schedules presented to the Commission under FPA section 205, and requesting hearing and settlement judge procedures. ATC may not argue that the MISO Show Cause Order is out of scope, because ATC itself made the MISO Show Cause Order an explicit part of its FPA section 205 case. Attempting to limit the relevance of the MISO Show Cause Order, ATC argues that the broader policy issues discussed in the Commission’s Show Cause Order raised here by the Wisconsin Commission and other intervenors are beyond the scope of ATC’s current filing. Yet the July 24 Filing repeatedly positions the MISO Show Cause Order and its policy rationales therein to be an integral part of the case for why the Agreements are just and reasonable.

Apple has officially launched its first foldable smartphone, the iPhone Duo. Featuring a book-style inward-folding design, the device comes with a 7.6-inch inner display and a 5.4-inch cover display. TrendForce estimates that iPhone Duo shipments will reach approximately 5 million units in 2026, giving Apple a 24.8% share of the foldable smartphone market and making it the second-largest brand behind Samsung.
